Terms of Service

capychat.tv is an adults-only platform. You must be at least 18 years of age to register for, access, or use the Service in any capacity. By accessing or using the Service, you represent and warrant that you are 18 years of age or older.

If capychat.tv learns or has reason to believe that a user is under the age of 18, we will immediately and permanently terminate that user's account, preserve any applicable records in accordance with our legal obligations, and report the matter to the appropriate authorities. capychat.tv is not directed to, and does not knowingly collect or retain information from, individuals under the age of 18.

Parents and guardians are responsible for monitoring the online activities of minors in their care and for ensuring minors do not gain access to capychat.tv. If you believe a minor is using or has used the Service, contact us immediately at legal@capychat.tv.

By accessing or using capychat.tv (the “Service”), you agree to be legally bound by these Terms of Service (“Terms”), our Privacy Policy, and any additional guidelines or policies we may post from time to time. If you do not agree to all of these Terms, you must immediately stop using the Service.

These Terms apply to all visitors, registered users, subscribers, and any other person who accesses or uses the Service in any manner. Your continued use of the Service after any modification to these Terms constitutes your acceptance of the revised Terms.

To access certain features of the Service you must register for an account. When registering, you agree to:

• Provide a username and password that are accurate and not impersonating any other person or entity.
• Maintain the security of your account credentials and not share them with any third party.
• Notify capychat.tv immediately if you suspect unauthorized use of your account.
• Accept full responsibility for all activity that occurs under your account, regardless of whether you authorized it.

capychat.tv reserves the right to reject, suspend, or terminate any account at its sole discretion and without prior notice. We are under no obligation to maintain your account or preserve any data associated with it.

You agree not to use the Service in any manner that violates applicable law or these Terms. Without limiting the foregoing, you are strictly prohibited from:

• Sexually explicit content— Broadcasting, transmitting, soliciting, or facilitating sexually explicit, pornographic, or obscene material of any kind, including nudity.
• Child sexual abuse material (CSAM)— Any depiction, distribution, solicitation, or discussion of child sexual abuse material or any content that sexually exploits minors. Violations will be immediately reported to the National Center for Missing & Exploited Children (NCMEC) and all relevant law enforcement agencies.
• Harassment, threats, and abuse— Threatening, bullying, stalking, intimidating, or harassing any individual through the Service.
• Hate speech and discrimination— Transmitting content that promotes hatred, violence, or discrimination against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Illegal activities— Using the Service to facilitate, promote, or engage in any activity that is unlawful under applicable law, including prostitution, sex trafficking, drug trafficking, fraud, or any other criminal conduct.
• Impersonation— Claiming to be another person, entity, or capychat.tv representative in a deceptive manner.
• Spam and commercial solicitation— Sending unsolicited commercial messages, promotions, or advertisements; repeatedly contacting other users against their wishes; or using the Service for any bulk or automated activity.
• Unauthorized data collection— Scraping, harvesting, or otherwise collecting information about other users without their explicit consent.
• Platform interference— Attempting to circumvent, disable, or interfere with the Service's security features, access controls, or moderation systems; distributing malware; or conducting denial-of-service attacks.
• Recording and redistribution— Recording, capturing, or redistributing any video or audio from chat sessions without the explicit consent of all participants.
• Circumventing bans— Creating a new account or using any other means to access the Service after your account has been suspended or banned.
• Misuse of features— Using any feature of the Service, including matching, chat, or reporting tools, in a manner inconsistent with their intended purpose.

Violations of this section may result in immediate account termination, referral to law enforcement, and civil or criminal liability. capychat.tv cooperates fully with law enforcement in all investigations of suspected illegal activity involving the Service.

You are solely and exclusively responsible for your own conduct, communications, and any content you transmit while using the Service. You acknowledge and agree that:

• You interact with other users entirely at your own risk. capychat.tv does not screen, verify, endorse, or vouch for any user and has no control over, and accepts no responsibility for, the actions, content, or behavior of any other user.
• capychat.tv is a platform and is not a party to any interaction, conversation, or agreement between users. Any dispute between users is solely between those users, and capychat.tv has no obligation to become involved.
• You will use the in-app reporting tools to promptly report content or conduct that you believe violates these Terms or applicable law.
• You will not hold capychat.tv liable for any content, statements, conduct, or omissions of any other user of the Service.
• You bear full responsibility for any consequences arising from your decision to share personal information with other users.

capychat.tv is designed with privacy in mind. Chat sessions are transient in nature. Messages, video sessions, and related communications are not intended to be stored permanently. We periodically purge certain records in the ordinary course of operating the Service, though we do not make guarantees regarding specific retention timeframes or schedules.

Certain metadata and moderation-related records (such as reports, bans, and administrative logs) may be retained for longer periods as required to operate the Service, enforce these Terms, comply with legal obligations, and protect the safety of our users and the public.

You should not rely on the Service as a means of preserving important communications. capychat.tv accepts no responsibility for any loss of data arising from the transient nature of the Service.

You retain ownership of any original content you create. By transmitting content through the Service, you grant capychat.tv a non-exclusive, royalty-free, worldwide license to process, transmit, and use that content solely to the extent necessary to provide the Service and fulfill our legal and safety obligations.

capychat.tv may offer premium or “Boost” features, including but not limited to gender-based matching filters, accessible via a paid subscription or one-time purchase (“Premium Features”).

• Payment and billing— Payments for Premium Features are processed by a third-party payment processor. By purchasing, you authorize us to charge your payment method the applicable fees.
• Non-refundable— All purchases of Premium Features are final and non-refundable except where required by applicable law. Unused access periods are forfeited upon account termination regardless of cause.
• Time-limited access— Premium Features are provided for the duration of the applicable subscription period or access window only. Access automatically expires at the end of the paid period.
• No guarantee of specific matches— Premium Features influence the matching algorithm but do not guarantee any specific number, frequency, quality, or type of match. capychat.tv makes no representations regarding match outcomes.
• Feature availability— We reserve the right to modify, limit, or discontinue any Premium Feature at any time without prior notice and without refund.
• Subscription cancellation— You may cancel a recurring subscription at any time; cancellation takes effect at the end of the current billing period and no partial refunds will be issued.

capychat.tv reserves the right, but not the obligation, to monitor, moderate, or review any use of the Service for compliance with these Terms and applicable law.

We reserve the right, in our sole and absolute discretion and without prior notice, to:

• Suspend, restrict, or permanently ban any account for any reason, including but not limited to suspected violations of these Terms, harmful conduct, or any other behavior we deem inconsistent with the safe operation of the Service.
• Remove, disable access to, or refuse to transmit any content that we determine, in our sole judgment, to be in violation of these Terms or otherwise objectionable.
• Cooperate with and disclose information to law enforcement, government authorities, or other third parties in connection with suspected illegal activity or safety concerns.

We are not obligated to provide any reason for moderation or enforcement actions. All enforcement decisions made by capychat.tv are final and not subject to appeal unless we determine, in our sole discretion, to review them.

The capychat.tv name, logo, domain, trade dress, and all associated marks, designs, software, and content created by capychat.tv are the exclusive intellectual property of capychat.tv and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the foregoing.

You may not use any capychat.tv marks, branding, or proprietary content without our prior written consent. Unauthorized use may give rise to claims for damages and may be a criminal offense.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. CAPYCHAT.TV EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, CAPYCHAT.TV DOES NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) ANY DEFECTS IN THE SERVICE WILL BE CORRECTED; (D) THE SERVICE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (E) ANY MATCHES OR INTERACTIONS THROUGH THE SERVICE WILL BE SATISFACTORY, APPROPRIATE, OR SAFE; OR (F) ANY CONTENT OR INFORMATION OBTAINED THROUGH THE SERVICE WILL BE ACCURATE, RELIABLE, OR COMPLETE.

YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CAPYCHAT.TV AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS, OR ANTICIPATED SAVINGS, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY CONTENT OR CONDUCT OF OTHER USERS OF THE SERVICE; (C) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL DATA STORED THEREIN; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE, EVEN IF CAPYCHAT.TV HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL CAPYCHAT.TV'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS PAID BY YOU TO CAPYCHAT.TV IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100).

THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, OR OTHERWISE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

You agree to defend, indemnify, and hold harmless capychat.tv and its owners, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content you transmit through the Service.

capychat.tv reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you agree to cooperate with us in asserting any available defenses.

These Terms and any dispute or claim arising out of or related to these Terms or the Service (including non-contractual disputes or claims) shall be governed by and construed in accordance with applicable law, without giving effect to any conflict of law principles that would require the application of the laws of any other jurisdiction.

To the extent permitted by law, any dispute arising from or relating to these Terms or the Service shall be resolved exclusively by binding arbitration on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section shall prevent either party from seeking emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or, if it cannot be so modified, severed from these Terms. The remaining provisions of these Terms shall remain in full force and effect.

capychat.tv reserves the right to modify these Terms at any time in its sole discretion. We will indicate that changes have been made by updating the “Last updated” date at the top of this page. It is your responsibility to review these Terms periodically. Your continued use of the Service after any modification constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service immediately.
